These Terms of Service explain how Social Hackettes INC works with clients. They are written in plain English so you can quickly understand your rights and responsibilities.
By using our website, purchasing a plan, or working with Social Hackettes, you agree to these Terms of Service. If you do not agree, please do not use our services.
We provide social media management, content creation, and Instagram/LinkedIn growth plans for small businesses and agencies.
Scope, timelines, and deliverables are defined in your selected package or written agreement. We may update methods over time to improve performance and quality.
How to cancel, in short
You can cancel anytime through your Stripe customer portal or by emailing support@socialhackettes.com. Cancellation stops all future renewals and takes effect at the end of the 30-day period you have already paid for. See Section 4.6 for full details.
Our services are sold on a recurring subscription basis. When you subscribe, you authorize us and our payment processor, Stripe, to charge your payment method the then-current subscription fee on a recurring basis. Each successful payment covers one thirty (30) day billing period, beginning on the date the payment is successfully processed. Your subscription automatically renews for successive 30-day billing periods, and your payment method will be automatically charged the then-current fee at the start of each renewal period, until you cancel or we terminate the subscription as described in these Terms. By subscribing, you affirmatively agree to these recurring, automatically renewing charges. We may change the subscription fee prospectively by giving you at least 30 days' advance notice by email; any fee change takes effect on your next renewal on or after the notice period ends, and continuing your subscription after that date constitutes acceptance of the new fee.
All services are provided only during a billing period for which payment has been received and confirmed, and only while your subscription is active and current. Access to services, deliverables, revisions, and support is a benefit of an active, paid subscription. It is not sold on a per-project, à la carte, or perpetual basis, and no services survive the billing period, unless a separate written agreement signed by us expressly says otherwise. If your subscription is not active and paid, we have no obligation to perform, prepare, schedule, publish, or deliver any work.
Each payment entitles you to request and receive services for that single 30-day billing period only. Work, deliverables, and revisions are allocated to the paid billing period in which they are requested and performed. Any request, edit, or revision you submit when you do not have an active, paid subscription (including requests made after a lapse, pause, or cancellation) will not be performed until your subscription is reactivated and payment is received and confirmed. Unused services, capacity, revisions, or deliverables do not roll over, accrue, carry forward, transfer, or convert to a refund or credit.
If any payment fails, is declined, is reversed, is charged back, or becomes past due, your account is past due and we may immediately pause, suspend, or withhold all services, including any work in progress, scheduling, publishing, and delivery, until the payment is resolved. While your account is paused for non-payment, we perform no services and owe no deliverables for the affected period. A non-payment pause does not shorten, extend, credit, or refund any billing period, and does not by itself cancel your subscription or revoke your authorization for automatic renewal charges. We are not responsible for any missed posting dates, scheduling gaps, or lapses in coverage that result from a failed or past-due payment.
If your subscription has lapsed, been paused, or been canceled, you may restore it by reactivating and paying the then-current subscription fee. Reactivation restores service on a going-forward basis only. It begins a new 30-day billing period on the date the reactivation payment is received and confirmed. Reactivation does not provide retroactive coverage, deliverables, or credit for any period during which your subscription was lapsed, paused, or canceled.
You may cancel your subscription at any time, effective at the end of your current paid 30-day billing period, through your Stripe customer portal or by emailing support@socialhackettes.com. Cancellation stops all future renewals and charges. It does not entitle you to any refund or partial refund of fees already paid. After you cancel, you remain entitled to services through the end of the billing period you have already paid for, subject to the No Refunds provisions in Section 3 (Payment & Billing). To avoid being charged for the next billing period, you must cancel before your renewal date. We will send you a confirmation once your cancellation is processed.
Our No Refunds policy in Section 3 (Payment & Billing) remains in full effect and controls. Each payment purchases a defined 30-day billing period, and we begin allocating and performing work after payment is received and confirmed. Accordingly, fees are fully earned when charged and are non-refundable once paid, including where you cancel mid-period, where services are paused for non-payment, or where you use fewer services than the period allows. A non-payment pause is not a refund event and does not entitle you to any refund, credit, or extension.
After your subscription is canceled or lapses, you will retain access to your project workspace (where we collaborate and share your files and deliverables) for thirty (30) days so you can download and save your finished deliverables and the materials you provided. It is your responsibility to retrieve everything you want to keep within that 30-day window. After 30 days, we may archive and permanently delete your project workspace, and we have no obligation to retain, restore, or provide access to any materials, files, or deliverables after that time. We recommend downloading anything you need before your subscription ends. Access under this Section is to finished deliverables and to materials you provided, and does not include editable working files, which are addressed in Section 6.3.
You agree to provide timely access to needed accounts, brand assets, and accurate business information. Delays in communication or approvals may delay deliverables.
You are responsible for maintaining account security and notifying us of any unauthorized access.
You retain ownership of your trademarks, logos, and materials you provide. Social Hackettes retains ownership of internal systems, templates, and proprietary workflows unless otherwise agreed in writing.
Deliverables are provided as finished, flattened export files in the formats and dimensions specified for your channels, for example JPG, PNG, PDF, and MP4. On payment of the applicable fees for the billing period in which a deliverable is produced, you receive the right to use, publish, and distribute those finished exports for your own business purposes, without time limit and after your subscription ends. While your subscription is active, we will update, resize, and produce new versions and variants of deliverables we created for you as part of your plan.
Editable, layered, and working source files, including but not limited to Canva design files and template links, layered PSD and Photoshop files, Illustrator and InDesign files and packages, project and timeline files, and the production templates, systems, and automations we use to create your deliverables, are our property and are not included in any package, plan, or deliverable. Transfer of, or a license to, any such working file is available only where all of the following are met before work begins: (a) you request it in writing; (b) we agree to it in writing as part of your scope; and (c) you pay the separate fee we quote for it. That fee is quoted individually and reflects the value of the ongoing production relationship the transfer replaces. Neither delivery of a finished export, nor any course of dealing, invoice description, or brief or specification you submit, transfers or grants a license to any working file.
By providing your phone number, you consent to receive SMS from Social Hackettes. Message and data rates may apply. Reply STOP to opt out.
You also agree to receive service-related communication by email and other standard contact methods used during your project.
To the maximum extent allowed by law, Social Hackettes is not liable for indirect, incidental, special, or consequential damages. Our total liability is limited to the amount you paid for the relevant service.
Either party may end services in writing if the other party materially breaches these terms. Fees already paid remain non-refundable.
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
